Personal Injury Settlement Restrictions
The Ontario government has made it difficult for accident victims to recover money for your pain and suffering and healthcare needs. To be entitled to either pain or suffering or healthcare compensation, you need to be able to prove that you have a permanent, serious impairment or a permanent, serious disfigurement. This is referred to as “The Threshold.” If you do not meet the threshold, you are not entitled to any pain and suffering or healthcare compensation. Even if you meet the statutory threshold, the government has also introduced something called a deductible. What this means is that if a jury awards you $50,000 in damages, you are only entitled to receive roughly $14,000. The deductible will not apply if your pain and suffering is worth more than $126,000.
